Director of Corrections requests approval of and authorization for the Chair to sign an agreement with MorphoTrust USA (formally Identix Inc) for a maximum of $11,338 for the term January 1, 2016 through December 31, 2016 for maintenance and repair services for the LiveScan machine located at the Napa County Jai.


6B

Agricultural Commissioner/Sealer of Weights and Measures requests approval of and authorization for the Chair to sign renewal of Revenue Agreement No. 4168 with the California Department of Food & Agriculture (CDFA) for a maximum of $84,843 for the term of July 1, 2015 through June 30, 2016 for reimbursement of expenditures associated with placing and inspecting of traps for the detection of exotic pests.

Director of Public Works requests approval of and authorization for the Chair to sign Amendment No. 3 to Agreement No. 7899 with Paula Stabler, doing business as "Facilities by Design," increasing the amount by $310,000 for a new maximum of $400,000 in Fiscal Year 2015-16 and by $160,000 for a new maximum of $250,000 in Fiscal Year 2016-17 and add Exhibit "C" - Compensation Schedule for space planning and reconfiguration services.

Director of Public Works requests approval of and authorization for the Chair to sign Amendment No. 1 to Agreement No. 8438 with Nacht & Lewis Architects Inc. increasing the amount by $83,520 for a new maximum of $112,990 amending the scope of work to include additional architectural and associated services for the planning of the new Jail and associated facilities.

Director of Public Works requests approval of and authorization for the Chair to sign a Space License Agreement with the Napa Chamber of Commerce with no license fee for the term December 9, 2015 through March 31, 2016 for the use of 1,064 square feet of space located at 933 Water Street.

Director of Public Works requests approval of plans and specifications for the "Napa County Hall of Justice Earthquake Epoxy Injection Repairs Project," PW 15-15D, authorization to advertise for sealed bids and opening of the bids at a time, date and location to be published by the Director of Public Works pursuant to Section 20150.8 of the Public Contract Code.

Director of Housing & Intergovernmental Affairs requests approval of and authorization for the Vice Chairman to sign an agreement authorizing the County of Napa to enter into an alliance with other government agencies, consulates, and non-profit organizations to increase visibility and outreach for the Employment, Education and Outreach (EMPLEO) program that helps recent immigrants by raising awareness of workplace rights and responsibilities in the United States.

Acting Director of Human Resources requests approval of and authorization to decrease the County's self-administered rate for the Dental Program with Delta Dental.

Acting Director of Human Resources requests adoption of a resolution to implement salary adjustments for five management positions in the Health and Human Services Agency resulting from a management compensation study conducted by Human Resources.

County Executive Officer and Risk/Emergency Services Manager request approval of and authorization for the Chair to sign Amendment No. 2 to Agreement No. 7214 with Gary D. Nelson Associates, Inc., doing business as The Nelson Family of Companies increasing the amount by $3,000 for a new maximum of $123,000 and amending the scope of work to include training in adult CPR, first aid and automated external defibrillators (AEDs).

County Counsel requests consideration and adoption of a Resolution of Findings of Fact and Decision on Appeal regarding the appeal filed by George Caloyannidis to a decision by the Planning Commission on June 17, 2015 to approve the Reverie on Diamond Mountain Winery - Use Permit Major Modification No. P13-00027 to allow the following: 1) increase the approved production capacity from 5,000 to 9,200 gallons per year with a condition on estate grown grapes for the net increase of 4,200 gallons; 2) the 1,460 sq.ft. second floor area of the winery building to be allocated to accessory use; 3) use of the 4,710 +/-sq.ft. cave for wine production, case storage and wine barrel storage; 4) increase in approved number of employees from two (2) full-time employees plus one (1) part-time employee during harvest to a maximum of five (5) full-time employees; 5) authorize on-premises consumption of the wines produced on-site, consistent with Business and Professions Code §23356, 23390, and 23396.5 (also known as AB 2004 (Evans Bill 2008 or the Picnic Bill)) within the winery building, in the redwood grove, and other designated outdoor areas; 6) catered food and wine pairings; 7) abandonment of an existing septic system and the installation of a new code compliant domestic and winery waste system subject to Condition of Approval No. 2(I); 8) installation of a temporary crush pad cover; 9) installation of a new ADA compliant parking space; 10) installation of a new well; 11) approval of “by appointment visitation” and a marketing plan; and 12) a historic rock bridge over Teal Creek (the Project).

The Project also includes a Use Permit Exception (No. P15-00141) to the Conservation Regulations with regards to retention of the following: 1) the portal for the existing wine cave that encroaches into the 45-foot creek setback for the small tributary creek on the property; and 2) the minor landscaping improvements along a portion of Teal Creek that are within the required setback of that creek. The Project further includes an Exception to the Napa County Road & Street Standards to allow for a reduction in the required 20 foot roadway width to preserve unique features of the natural environment.

The Project is located on a 39.83 acre parcel approximately 1,000 feet west of Diamond Mountain Road and approximately 4,000 feet from its intersection with State Highway 29/128, within the AW (Agricultural Watershed) Zoning District; 1530 Diamond Mountain Road, Calistoga, CA, APN: 020-440-005. 

ENVIRONMENTAL DETERMINATION: Consideration and possible adoption of a Negative Declaration. According to the proposed Negative Declaration, the proposed Project would have no potentially significant environmental impacts. This Project site is not on any of the lists of hazardous waste enumerated under Government Code Section 65962.5.

Director of Planning, Building, and Environmental Services requests discussion and possible direction regarding the recommendations being forwarded by the Planning Commission from the Agricultural Protection Advisory Committee (APAC) to improve existing land use policies, codes, and practices.

Director of Planning, Building and Environmental Services requests adoption of a resolution establishing certain Agricultural Preserves (Types A & H), and approval of and authorization for the Chair to execute the following Williamson Act related contracts:

  1. Rescinding two (2) existing contracts and replacing with two (2) new contracts both with the following applicant:
    1. Nichelini vineyards LLC, in the general location of Lower Chiles Valley Road and Sage Canyon Road (2 new contracts).
  2. Approving five (5) new contracts with the following applicants:
    1. KT Wineco, Limited Liability Company, in the general location of Oakville Grade and Acacia Drive.
    2. Treasury Wine Estates Americas Company, in the general location of Big Ranch Road and Salvador Avenue.
    3. Sori Bricco Vineyards, Limited Liability Company, in the general location of Kortum Canyon Road and the City of Calistoga.
    4. St. Supery, Inc., (formerly known as Skalli Corporation) in the general location of State highway 29 and Manley Lane.
    5. St. Supery, Inc., (formerly known as Skalli Corporation) in the general location of Dollarhide Road and Hardin Road.

ENVIRONMENTAL DETERMINATION:  Categorical Exemption Class 17: Open Space Contracts or Easements. It has been determined that this type of project does not have a significant effect on the environment and is exempt for the California Environmental Quality Act. [See Class 17 (Open Space Contracts or Easements) which may be found in the guidelines for the implementation of the California Environmental Quality Act at Title 14 CCR Section 15317.]
