Request: Review and make recommendations on proposed
amendments to:
1. The
a. Adoption of an
updated Housing Element.
b. Amendments to the
Land Use Element of the Napa County General Plan to make clear that the minimum
parcel size for lands in the Urban Residential and Rural Residential land use
designations may be lowered where allowed in the updated Housing Element.
c. Amendments to
the Growth Management System of the Napa County General Plan raising the
allocation of residential building permits from 109 to 114 dwelling units,
changing the qualifications for Category 4 permits from 100% of median income
to 120% of median income, and allowing unused permits to accumulate for a
rolling three year period. Moreover, per
the request by the California Department of Housing and Community Development,
the Growth Management System Element is amended to tie the review of any
changes in the annual population growth rate with the 5 year housing element
cycle and to allow consideration of data from both the State Department of
Finance's Demographic Research Unit and the U.S. Census. In addition, Chapter 8.02 of the Napa County
Code is amended to make it consistent with these General Plan amendments.
2. The
a. Zoning
Ordinance amendments adding a new Chapter 18.82 to Title 18 of the Napa County
Code, creating an Affordable Housing Combination District. The Affordable
Housing Combination District would do all of the following: (i) apply to
parcels identified in Appendix H of the Draft Housing Element; (ii) allow the
construction of a variety of affordable housing types (low, very-low and
moderate income) on parcels identified in the Draft Housing Element; (iii)
allow

a. Continued
development up to specified densities by right if the
development meets identified standards; and (iv) require the affected housing
to remain at affordability levels for a minimum of 40 years.
b. Addition of a
new Chapter 18.107 to Title 18 of the Napa County Code to bring the zoning
ordinance into compliance with state density bonus laws. Government Code
section 65915 requires cities and counties to give a 25% bonus and one
additional incentive to a developer who agrees to commit (i) either 20% of the
housing units affordable to lower income households, or (ii) 10% of the units
affordable to very low income households.
c. Zoning
Ordinance amendments to sections 18.08.293, 18.08.294, 18.16.030, 18.20.030,
18.104.300, and 18.104.305 and adding a new section 18.104.295 to Title 18 of
the Napa County Code, to bring the
d. Zoning
Ordinance amendments to sections 18.36.030 and 18.44.020 of Title 18 of the
Napa County Code to allow homeless shelters as an allowed use upon grant of a
use permit in the Industrial Zoning District and the General Industrial Zoning
District.
e. Zoning
Ordinance amendment to section 18.60.070 of the Napa County Code to increase
the density ceilings of the Residential Multi-Family and Planned Development
Zoning Districts from 16 units per acre to 20 units per acre.
f.
Zoning Ordinance amendment to section 18.48.090
of the Napa County Code to exempt affordable housing projects from the 30-acre
minimum requirements for the Planned Development Zoning District.
g. Amendments to
Chapter 8.02 of the Napa County Code relating to the Housing Allocation Program
requiring evaluation of population and housing data more frequently than every
ten years and bringing it into conformity with the Growth Management System
Element.

3. Rezoning of various parcels identified
below to include the parcels in the Affordable Housing Combination District,
new Chapter 18.82. The project broadly
affects various parcels throughout the County, and specifically rezones the
following parcels: Assessor’s Parcel
#024-410-007, 024-080-024, 039-320-016, 039-320-006,
049-110-005, 032-150-003, 032-150-048, 032-150-047,
019-261-028, 019-261-035, 019-261-026, 019-261-025, 019-262-001,
019-050-003.
California Environmental Quality Act (CEQA) Status: Environmental
Assessment prepared pursuant to Government Code section 65759. The proposed project would have, if
mitigation measures are not included, potentially significant environmental
impacts in the following: Aesthetics,
Air Quality, Biological Resources, Cultural Resources, Geology, Soils and
Seismicity, Hazards and Hazardous Materials, Hydrology and Water Quality,
Noise, Population, Public Services, Transportation and Utilities and Service
Systems. The project sites are not on
one of the lists of hazardous waste sites enumerated under Government Code
section 65962.5.

According to the Negative Declaration, the project will have no
potentially significant impacts on the environment.
Request:
Approval of a Use Permit to establish a new 25,000-gallon per year
winery with: (1) 16,970 square foot of existing caves, for a winery totaling
16,970 square feet; (2) custom crushing activities (crushing, fermentation,
barrel aging and bottling) for up to four entities utilizing 40% (10,000
gallons per year) of the total winery production capacity per year; (3) two
full-time and one part-time employees; (4) nine parking spaces; (5) tours and
tasting by appointment with a maximum of 8 people per day, 40 per week only;
and, (6) a marketing plan that includes: 12 promotional tours, tastings and
meals per year with a maximum of ten people at each event, two release events
per year with a maximum of sixty people at each event and one wine auction
event per year with a maximum of fifty people.
This project is located on two parcels (pending a lot line adjustment)
of 40 and 40.11 acres off a private road at the terminus of Kreuzer Lane
approximately 3,000 feet east of its intersection with Fourth Avenue within an
AW (Agricultural Watershed) zoning district.

CEQA
Status: Mitigated Negative Declaration Prepared. According to the Mitigated
Negative Declaration, the proposed project would have, if mitigation measures
are not included, potentially significant environmental impacts in the
following areas: Hydrology & Water Quality, and Transportation & Traffic.
Request: Approval to modify Use Permit #94043-UP and
to permit extraction of 185 acre feet per year of spring water from three bore
holes on the Montesol Ranch property.
(The current Use Permit authorizes the extraction of 115 acre-feet per
year from three bore holes.) No site
improvements or new construction are associated with this application. The water will be delivered to an off-site
facility for commercial processing and bottling. The project area includes approximately
800-acres of the ±9,000 acre Montesol Ranch on the east side of the
(Assessor’s
Parcels 016-010-011 & 012, and 016-020-029).

Mitigated
Negative Declaration Prepared. According to the Mitigated Negative
Declaration, the proposed project would have, if mitigation measures are not
included, potentially significant environmental impacts in the following areas: hydrology & water quality, transportation
& traffic.
Request: Approval to modify Use Permit(s) U-757576 and
U-568081 to: (1) increase production capacity from 120,000 gallons to 180,000
gallons per year; (2) construct a 3,530 square
foot building for bottling; a 1,230 square foot addition to the
Finishing Building for offices and employee area; convert the first floor of
the Sales Building from a bottling room to additional storage/office/kitchen
space, and the existing 6,389 square foot barn from wine storage to an office
space and assembly room for marketing events; utilize an existing 1,242 square
foot residence for a tasting room, storage and office space and an existing 643 square
foot bunk house for storage and office space; and, construct
an additional 24,200 square feet of caves (to the
existing 29,871 square feet of caves) for a winery totaling 94,866; (3) add
1,136 square feet of covered work and storage area; (4) increase
full-time employees from 8 to 36; (5) increase
Tours/Tasting by appointment only from a maximum of 64 visitors per day;
(6) recognize an existing Marketing Plan consisting
of: 1 event for a maximum of 80 persons
per year, 20 events with a maximum of 70 persons per year, 20 events with a maximum
of 10 person per year, and 1 Wine Auction event with a maximum of 50 persons
per year;
(7) expand the existing engineered septic system;
and, (8) construct improvements to Schramsberg Road
and install a left-turn lane.
This project is located on a 39.30 acre
parcel at the terminus of

Use Permit Request #04026-UP
CEQA
Status: Negative Declaration Prepared. According to the proposed Negative Declaration,
the proposed project would have no potentially significant environmental
impacts. Request: Approval of a Use Permit to establish an
agricultural processing facility within a proposed 860 square foot replacement
structure for the processing of fruit and herbs grown on-site into jams,
jellies, sauces, chutney and dried herbs and will include: (1) one full-time employee; (2) three parking
spaces; (3) improvement of the existing access road; (4) construction of a
new wastewater system; and (5) installation of a 12,000 gallon water tank for
fire protection. No retail sales or
marketing events are proposed on the site.
The project is located on a 4.07-acre parcel approximately 570 feet west
of Silverado Trail and 850 feet north of
(Assessor’s Parcel #: 039-270-016) 2083 Silverado Trail,
