June 16, 2004

 

1.                  Call to Order.

THE CONSERVATION, DEVELOPMENT AND PLANNING COMMISSION OF THE COUNTY OF NAPA MET IN REGULAR SESSION, WEDNESDAY, JUNE 16, 2004, AT 9:00 A.M.  THE MEETING WAS CALLED TO ORDER BY CHAIR SCOTT AT 9:00 A.M.

 

 

2.                  Roll Call.

THE FOLLOWING MEMBERS WERE PRESENT:  CHAIRPERSON TERRY SCOTT, COMMISSIONERS BOB FIDDAMAN, JIM KING, DAVID GRAVES AND JOHN DICKSON.

8.                  Balloons Above the Valley, Inc. / Robert Barbarick Trust Etal – Use Permit Modification Request #03476-MOD                                                                                                                                             
California Environmental Quality Act (CEQA) Status:  Mitigated Negative Declaration Prepared.  According to the Mitigated Negative Declaration, the proposed project would have, if mitigation measures are not included, a potentially significant environmental impact in the following areas:  noise.

Request:  Approval to modify Use Permits 91182-UP, 92406-MOD, and 96692-MOD to: (1) launch up to 5 balloons per day from the south parking lot adjacent to the Red Hen Antiques building between the hours of 6:00 a.m. and 9:00 a.m. with staff arriving no earlier than 5:00 a.m.; and, (2) parking for passengers in the existing south parking lot and no more than 5 vans or trailers in the existing parking spaces immediately to the north of the Red Hen Antiques building.  The project is located on a 3.5 acre parcel on the west side of Solano Avenue immediately south of its intersection with Oak Knoll West Avenue within a CL (Commercial Limited) zoning district.  (Assessor’s Parcel #035-031-009)   5091 Saint Helena Highway, Napa.  (Continued from April 21, May 05, June 02, 2004)

9.                  Michael Parmenter and Kiky Lee / Fox Peak Winery – Use Permit Request #04004-UP
CEQA Status:  Negative Declaration Prepared.  According to the proposed Negative Declaration, the proposed project would have no potentially significant environmental impacts.
Request:  Approval of a Use Permit to establish a new 18,000 gallon per year winery with:  (1) 2,500 square feet of caves for a winery totaling 2,500 square feet; (2) one full-time and two part-time employees; (3) four parking spaces; and, (4)  tours and tasting by appointment only. No custom crushing and no marketing plan activities are proposed.  This project is located on a 32.31 acre parcel on the west side of Atlas Peak Road approximately 6 miles north from its intersection with Old Soda Springs Road within the AW (Agricultural Watershed) zoning district.  (Assessor’s Parcel # 032-080-023)   4015 Atlas Peak Road, Napa.  (Recommend continuing to July 07, 2004)

10.              Silverado Napa Corporation – Tentative Parcel Map Request #04147-PM        
CEQA Status:  Mitigated Negative Declaration Prepared.  According to the Mitigated Negative Declaration, the proposed project would have, if mitigation measures are not included, potentially significant environmental impacts in the following areas:  aesthetics, air quality, biological resources, geology & soils, hydrology & water quality and noise.         
Request:  Approval to divide a ±455-acre site into two parcels consisting of 215 acres (Parcel 1) and 240 acres (Parcel 2).  The site is generally located to the east of the Silverado subdivisions, south of Atlas Peak Road, and north of Monticello Road within the AW (Agricultural Watershed) zoning district.  (Assessor’s Parcel #’s: 061-040-004 SFAP and

061-180-001 SFAP)

14.              Commissioner Comments.

COMMISSIONER GRAVES ASKED STAFF HOW MANY WINERY USE PERMITS HAVE BEEN DEEMED COMPLETE AND HOW MANY ARE IN THE PROCESS OF COMING BEFORE THE COMMISSION.

 

MR. LEDERER RESPONDED APPROXIMATELY 30 TO 40 ARE IN SOME FORM OF COMPLETENESS.  IN ADDITION, THE DEPARTMENT RECEIVED A TREMENDOUS AMOUNT OF APPLICATIONS IN JANUARY JUST BEFORE THE FEES CHANGED.

COMMISSIONER DICKSON COMMENTED THAT HE WAS LISTENING TO THE RADIO RECENTLY AND HEARD AN APPLICANT, THAT HAS BEEN BEFORE THE COMMISSION REGARDING THE HELICOPTER PROPOSAL, SPEAKING ABOUT AN ADVERTISEMENT IN THE LOCAL NEWSPAPER.   COMMISSIONER DICKSON READ THE AD AND IT APPEARED TO BE A CLARIFICATION OF WHAT THE BOARD OF SUPERVISORS STATED DURING A RECENT MEETING.  COMMISSIONER DICKSON ASKED STAFF IF THE AD WAS PUBLISHED AS A PUBLIC SERVICE.

 

MR. LEDERER RESPONDED THE DEPARTMENT, AS NEEDED, PUTS ADS IN THE NEWSPAPER TO HELP CLARIFY COUNTY POLICY.  OVER THE PAST YEAR, THE DEPARTMENT HAS PUBLISHED ADS CLARIFYING THE REQUIREMENTS FOR TEMPORARY EVENTS AND SIGN USAGE.  MR. LEDERER STATED THAT DUE TO THE LARGE PUBLIC INTEREST IN THE HELICOPTER ISSUE, THE AD WAS PUBLISHED TO CLARIFY COUNTY POLICY AND THE BOARD OF SUPERVISORS COMMENTS.

 

 

15.              Director's Report on Board of Supervisors' Actions.

MR. LEDERER COMMENTED THAT THE CONSERVATION, DEVELOPMENT & PLANNING DEPARTMENT DIRECTOR, CHARLES WILSON, ANNOUNCED HIS RETIREMENT.    MR. WILSON’S LAST DAY IN THE OFFICE IS JUNE 30, 2004.  MR. LEDERER COMMENTED THAT HE WILL UPDATE THE COMMISSION REGARDING ARRANGEMENTS FOR THE RETIREMENT PARTY.
