1.                  Call to Order.

THE CONSERVATION, DEVELOPMENT AND PLANNING COMMISSION OF THE COUNTY OF NAPA MET IN REGULAR SESSION, WEDNESDAY, SEPTEMBER 4, 2002, AT 9:00 A.M. 

           

 

2.                  Roll Call.

THE FOLLOWING MEMBERS WERE PRESENT:  CHAIRPERSON DAVID GRAVES, COMMISSIONERS TONY HOLZHAUR, LARRY SCHOENKE, TERRY SCOTT AND JIM KING.

7.                  Verizon Wireless & Nextel Communications I-80 Site/Joseph Hensley - Use Permit Request #01097-UP      
California Environmental Quality Act (CEQA) Status: Categorical Exemption.   
Request:
  To establish an unmanned communications facility on a 20 by 30 foot leased area on the west side of the I-80 Freeway consisting of:  (1) a 49 foot tall ground-mounted structure designed as a water tank with 12 sector panel arrays attached inside the structures, each having a width of 15 inches, a depth of 12 inches and a length of 96 inches; (2) installation of one four foot diameter dish mesh antenna located inside the structure; (3) construction of a 240 square foot, 12 foot tall prefabricated ground-mounted equipment structure containing emergency battery power back-up and similar support equipment enclosed by a six foot chain link fence; (4) construction of a new eight foot wide gravel private access road approximately  880 feet in length; (5) installation of approximately 760 linear feet of new overhead electrical power and telecommunication cables to serve the new facility; (6) construction of a small GPS (Global Positioning Satellite) antenna on the proposed equipment building; and, (7) installation of a new facility sign as required by County ordinance, located on a 20.44 acre parcel on the south side of American Canyon Road and northeast of Canyon Road within an AW (Agricultural Watershed) zoning district  (Assessor’s Parcel # 059-060-026).  (Continued from July 3, 2002).

8.                  Peanut Winery/Peanut LLC - Use Permit Request #00323-UP

CEQA Status:  Mitigated Negative Declaration Prepared.        
Request:
  Approval of a Use Permit to establish a new 15,000-gallon per year winery with:  (1) a 4,223 square foot building for fermentation, storage and lab, a 2,632 square foot building for administration and storage and 4,885 square feet of caves for barrel storage for a winery totaling 11,740 square feet; (2) two full-time employees with five additional full-time employees during crush; (3) a maximum of 30 visitors per week; (4) six parking spaces; (5) tours and tasting by appointment only for two to four people, four times per month; (6) a marketing plan with four activities per year with a maximum of ten people per event and one luncheon related to the wine auction for a maximum of 30 people; (7) construction of a standard sewage system and storage tanks for domestic water storage and fire protection; and, (8) improvements to the drainage at the intersection of North Fork Crystal Springs Road and Silverado Trail, located on a 30.37-acre parcel on the east side of North Fork Crystal Springs Road, approximately 1,738 feet from its intersection with Silverado Trail within an AW (Agricultural Watershed) zoning district.  (Assessor’s Parcel #021-420-007)  230 North Fork Crystal Springs Road, St. Helena. 9.                  Sloan Winery/Merle Coyhn Trust – Use Permit Modification Request #02166-MOD

CEQA Status:  Categorically Exempt

Request:  Approval to modify Use Permit #01206-UP to:  (1) allow use of an additional 5,600+ square feet of an existing cave (in addition to the 3,700 square feet previously approved) for wine storage and, (2) allow custom crushing activities (crushing, barrel aging and bottling) for one custom producer utilizing 33.3% (5,000 gallons per year) of the total approved 15,000 gallon production capacity.  No other changes are requested.  The parcel is located on a 40.23 acre parcel on a private driveway on the south side of Auberge Road approximately ˝ mile from its intersection with Rutherford Hill Road within an AW (Agricultural Watershed) zoning district.  (Assessor’s Parcel #030-300-035) 88 Auberge Road, Rutherford.

10.              Proposed Ordinance #02302-ORD.   An ordinance amending Title 18 by adding a new chapter 18.126 and revising chapters 5.36.030, 5.36.040, 5.36.050, 5.36.060, 5.36.070, 5.36.080, 5.36.100, 5.36.120, 5.36.130, 15.40.010, 15.40.030, 15.40.040, 15.40.050, 15.40.060, 15.40.070, 15.40.080, 15.40.090, 15.40.100, 15.40.110, 15.40.120, 15.40.130, 15.40.210, 18.10.020, 18.104.080, 18.104.090, 18.104.270, 18.104.275, 18.116.030, 18.116.035, 18.116.055, 18.116.120, 18.120.010, 18.124.080, 18.124.100, 18.124.110, and 18.124.130 of the Napa County Code regarding Administrative Permits.

11.       Proposed Zoning Ordinance Amendment Request (#02304-ORD) to amend Chapter 18.108 (Conservation Regulations) by amending Sections 18.108.020 (General Provisions), 18.108.025 (General Provisions-Intermittent/Perennial Streams), 18.108.030 (Definitions), 18.108.040 (Exceptions), 18.108.050 (Exemptions), and 18.108.055 (Exemption from Discretionary Permit) and to amend Chapter 16.05.750 (Riparian Zones-Restricted Activities) of the Napa County Code.  The proposed ordinance will:

            a)         Establish for County regulatory purposes a new biologically-based stream classification system similar to that used by the State Department of Forestry and the State Department of Fish & Game;

            b)         Increase stream setbacks to 150 feet on all Class III streams;

            c)         Limit the activities that are allowed within a portion of the stream setbacks;

            d)         Establish procedures and criteria for approving reduced stream setbacks;

            e)         Provide new definitions and clarify existing definitions; and;

            f)          Repeal certain out-dated provisions of the Floodplain Management Ordinance that may conflict with the new regulations being established hereunder.

CHAIRPERSON GRAVES RECUSED HIMSELF FROM THIS ITEM DUE TO A CONFLICT OF INTEREST.

15.       Commissioner Comments.

COMMISSIONER KING INQUIRED REGARDING THE STATUS OF FALL 2002 PLANNING COMMISSIONER’S CONFERENCE AND ADVISED THAT NAPA IS STILL PLANNING TO SPONSOR A FALL 2003 PLANNING COMMISSIONER’S CONFERENCE.

COMMISSIONER SCHOENKE INQUIRED REGARDING THE STATUS OF THE MONTALCINO, MAI CHARDONNAY AND THE DOCTOR’S COMPANY PROJECTS AND EXPRESSED CONCERNS RELATED TO REGIONAL TRAFFIC ISSUES.  

MR. LEDERER RESPONDED THAT THE MONTALCINO PROJECT IS AWAITING COMPLETION OF A TRAFFIC STUDY, AND THE MAI CHARDONNAY AND THE DOCTOR’S COMPANY PROJECTS HAVE BEEN PLACED ON HOLD BY THE APPLICANTS.

CHAIRPERSON GRAVES EXPRESSED CONCERN REGARDING THE PROCESS IN RELATION TO MONTALCINO AND EX PARTE COMMUNICATIONS.

 

COMMISSIONER KING ADVISED HE WOULD NOT BE IN ATTENDANCE FOR THE REMAINDER OF TODAY’S PLANNING COMMISSION MEETING.

 

 

16.              Director's Report on Board of Supervisors' Actions.

STEVE LEDERER, DEPUTY PLANNING DIRECTOR, REPORTED ON THE FOLLOWING:

TOM EDDY WINERY USE PERMIT DECISION WAS UPHELD IN THE COURTS.

BOARD OF SUPERVISORS MET YESTERDAY REGARDING CARNEROS LODGE AND APPROVED A REDUCED SCALE PROJECT CONSISTING OF 25 ROOMS, A 100-SEAT RESTAURANT, 2500 SQUARE FEET OF RETAIL AND A REDUCED CONFERENCE CENTER.

PAHLMEYER APPEAL WAS SETTLED. 

STONY SPRINGS/COOK WINERY WAS APPEALED AND WILL GO TO THE BOARD OF SUPERVISORS. 

BOARD OF SUPERVISORS APPROVED A CHANGE TO THE APPEALS ORDINANCE WHICH DECREASES THE TIME IN WHICH AN APPEAL MUST BE FILED.
