      THE CONSERVATION, DEVELOPMENT AND PLANNING COMMISSION OF THE COUNTY OF NAPA MET IN REGULAR SESSION, WEDNESDAY, JULY 17, 2002, AT 9:00 A.M.

THE FOLLOWING MEMBERS WERE PRESENT:  VICE-CHAIRPERSON LARRY SCHOENKE, COMMISSIONERS, TERRY SCOTT AND JIM KING.  CHAIRMAN GRAVES AND COMMISSIONER HOLZHAUER WERE EXCUSED.

7.         Stoney Springs Vineyards Winery/Glenn Cook and Gayle Shurtz - Use Permit Request #01148-UP    
California Environmental Quality (CEQA) Status:  Mitigated Negative Declaration Prepared.    
Request:  Approval to modify Use Permit Exemption #SW-198889 to: (1) increase the production capacity from 6,500 to 20,000 gallons per year; (2) construct a 1,400 square foot winery addition for a total winery floor area of 2,789 square feet; (3) increase the number of custom producers from one to six who will utilize 30% (6,000 gallons per year) of the proposed production capacity; (4) modify custom production activities to include retail wine sales, one administrative office, distribution and shipping, tours and tasting by appointment only; (5) allow a maximum of two of the four employees for custom production activities; and, (6) add a marketing plan to recognize one private marketing event and add two custom producer marketing events for a total of 3 annual private promotional events with a maximum of 150 person per event, located on a 18.84 acre parcel at the terminus of North Fork Crystal Springs Road approximately 3,000 feet east of Silverado Trail within an AW (Agricultural Watershed) zoning district.  (Assessor’s Parcel #021-030-032)  264 Crystal Springs Road, St. Helena.  (Continued from June 5, 2002 and to be continued to August 7, 2002)

Request:  Approval of a Use Permit to establish a new 12,000 gallon per year winery with:  (1) a 3,000 square foot winery building; (2) custom crushing activities (crushing, fermentation, and bottling) for up to one custom producer utilizing 30% (3,600 gallons per year) of the total approved winery production capacity; (3) two part-time employees; (4) an average of 2.5 visitors per week; (5) four parking spaces; (6) tours and tasting for members of the wine trade by appointment only with no other marketing activities proposed, located on a 20.06 acre parcel west of Green Valley Road approximately 4,500 feet south of its intersection with Wild Horse Valley Road, within an AW (Agricultural Watershed) zoning district.  (Assessor’s Parcel # 045-310-037)  1187 Green Valley Road, Napa.  (Continued from July 3, 2002)

9.         Peanut Winery/Peanut LLC - Use Permit Request #-00323-UP    
CEQA Status:  Mitigated Negative Declaration Prepared.        
Request:  Approval of a Use Permit to establish a new 15,000-gallon per year winery with:  (1) a 4,223 square foot building for fermentation, storage and lab, a 2,632 square foot building for administration and storage and 4,885 square feet of caves for barrel storage for a winery totaling 11,740 square feet; (2) two full-time employees with five additional full-time employees during crush; (3) a maximum of 30 visitors per week; (4) six parking spaces; (5) tours and tasting by appointment only for two to four people, four times per month; (6) a marketing plan with four activities per year with a maximum of ten people per event and one luncheon related to the wine auction for a maximum of 30 people; (7) construction of a standard sewage system and storage tanks for domestic water storage and fire protection; and, (8) improvements to the drainage at the intersection of North Fork Crystal Springs Road and Silverado Trail, located on a 30.37-acre parcel on the east side of North Fork Crystal Springs Road, approximately 1,738 feet from its intersection with Silverado Trail within an AW (Agricultural Watershed) zoning district.  (Assessor’s Parcel #021-420-007)  230 North Fork Crystal Springs Road, St. Helena.  (To be continued indefinitely due to Urgency Ordinance)

CEQA Status:  Mitigated Negative Declaration Prepared.        
Request:  Approval of a Use Permit to establish a new 20,000 gallon per year winery with:  (1) use of a 1,360 square foot portion of an existing barn and 5,000 square feet of caves, with two portals (one inside the barn) for a winery totaling 6,360 square feet; (2) 1,400 square feet of crush, press and fermentation tank pads on existing hillside terraces; (3) custom crushing activities (crushing, fermenting, barrel aging and bottling) for a maximum of one custom producer utilizing 50% (10,000 gallons per year) of the total approved winery capacity; (4) one full-time employee; (5) a maximum of 50 visitors per week; (6) 12 parking spaces; (7) tours and tasting by appointment only; (8) limited on-site wine sales; and, (9) a marketing plan with four private tastings per year (quarterly) with catered meals with a maximum 20 people per event, located on a 18.47 acre parcel on the east of Silverado Trail approximately 1,000 feet from its intersection with Glass Mountain Road, within an AW (Agricultural Watershed) zoning district.  (Assessor’s Parcel # 021-200-004), 3242 Silverado Trail, St. Helena.

11.       Folie `a Deux Winery– Use Permit Modification Request #00395-MOD
CEQA Status:  Categorical Exemption 
Request:  Approval to modify Use Permit # U-18182 to allow the previously approved winery to the following:  (1) increase production capacity from 85,000 gallons per year to 100,000 gallons per year; (2) revise the previously approved #95081-MOD marketing plan which permitted 6-12 promotional events per year with an average of 9 to 6-12 per year (removing the average of 9).  No other changes to the winery are proposed.  The parcel is located on a 21.03-acre parcel on the east side of Highway 29, approximately 1,250 feet southeast of Ehlers Lane within an AW (Agricultural Watershed) zoning district. (Assessor’s Parcel #022-100-010)  3070 St. Helena Highway North.

THE NAPA COUNTY AIRPORT LAND USE COMMISSION (ALUC) WILL BE MEETING AUGUST 7, 2002, AND THE BOARD OF SUPERVISORS APPOINTED A NEW ALUC COMMISSIONER, DEAN STAHR.   HE FURTHER ADVISED THE ALUC WILL REVIEW THE NEW SHERIFF’S FACILITY.

 

 

15.       Commissioner Comments.

COMMISSIONER KING REQUESTED STAFF ADD TO THE ALUC AGENDA FOR AUGUST 7, 2002 AN UPDATE REGARDING THE STANLEY RANCH PROJECT.

 

COMMISSIONER KING REQUESTED STAFF PROVIDE AN UPDATE ON THE CURRENT PHILOSOPHY REGARDING THE ENFORCEMENT EFFORT AND STAFFING, INCLUDING SUBSTANTIATION BEHIND THE PHILOSOPHY.

 

 

16.       Director's Report on Board of Supervisors' Actions.

BOB NELSON, SUPERVISING PLANNER, ADVISED THE FIREWORKS POLICY HAS BEEN CHANGED.    FIREWORKS ARE NOW  HANDLED BY THE DEPARTMENT OF FORESTRY AND ARE SEPARATE FROM TEMPORARY EVENTS LICENSES.    

 

IN RESPONSE TO MR. NELSON’S REPORT REGARDING FIREWORKS, THE COMMISSION RECOMMENDED THIS ITEM BE DISCUSSED AT THE NEXT PLANNING COMMISSION MEETING WHEN COMMISSIONER HOLZHAUER IS PRESENT, SINCE HE INITIATED THE FOLLOW-UP TO THIS ITEM.

 

MR. NELSON PROVIDED COMMENTS IN RESPONSE TO PUBLIC TESTIMONY PROVIDED EARLIER TODAY ALONG WITH COMMISSIONER’S CONCERNS AS THEY RELATE TO SECOND UNITS AND GUEST UNITS.  HE ADVISED THESE UNITS ARE CONSTANTLY CAUSING PROBLEMS WITHIN THE DEPARTMENT AND HE WOULD NOT MIND SEEING CLEAN-UP LANGUAGE TO CLARIFY CURRENT DEFINITIONS TO THE ORDINANCE.

 

COMMISSIONER SCOTT SUGGESTED STAFF PREPARE DRAFT CLEAN-UP LANGUAGE TO CLARIFY THE DEFINITIONS OF SECOND UNITS AND GUEST UNITS FOR DISCUSSION AT A FUTURE PLANNING COMMISSION MEETING.

STEVE LEDERER, DEPUTY DIRECTOR, REPORTED ON THE FOLLOWING:

 

THE BOARD OF SUPERVISORS AT THEIR MEETING JULY 9, 2002 DECLARED INTENT TO DENY THE APPEAL OF THE  GROVER WINERY USE PERMIT NO. 00325-UP AND UPHELD THE DECISION BY THE PLANNING COMMISSION.   IN ADDITION, THE BOARD REQUESTED THE PLANNING DEPARTMENT AND COUNTY FIRE CONTINUE  TO LOOK AT WHAT PERMITS THE COUNTY APPROVES IN THE HILLSIDES AS THEY RELATE TO FIRE ISSUES.

 

THE BOARD OF SUPERVISORS WILL CONSIDER AN EXTENSION OF THE STREAM SETBACK URGENCY ORDINANCE AT THEIR MEETING JULY 23, 2002.  THE ORDINANCE WILL LIKELY BE EXTENDED UNTIL AN INTERMEDIATE ORDINANCE IS APPROVED.

 

THE BOARD OF SUPERVISORS AT THEIR MEETING JULY 16, 2002 CONSIDERED A REVISED, SMALLER PROJECT SUBMITTED BY THE APPLICANT FOR CARNEROS LODGE AND AUTHORIZED STAFF TO MOVE FORWARD WITH PREPARATION OF A REVISED FINAL ENVIRONMENTAL IMPACT REPORT.   STAFF HAD PREPARED A WATER ANALYSIS BASED ON A 70 PERCENT OCCUPANCY, AND THE BOARD SUGGESTED THE WATER ANALYSIS BE PREPARED BASED ON 80 PERCENT OCCUPANCY IN ORDER TO PROVIDE A MARGIN OF ERROR.   THE  BOARD WILL CONSIDER THIS PROJECT AT ITS HEARING SET FOR AUGUST 20, 2002.

 

 

17.       Zoning Administrator Actions for July, 2002.

18.              Future Agenda Items.

MR. LEDERER ADVISED OF THE FOLLOWING FUTURE AGENDA ITEMS:

 

THE COMMISSION WILL CONSIDER A PROPOSED DAY CARE CENTER AND HEALTH CLUB IN THE AIRPORT AREA AT THEIR MEETING AUGUST 21, 2002.

 

            THE MONTALCINO PROJECT WILL PROBABLY BE BACK BEFORE THE COMMISSION SOME TIME IN NOVEMBER WITH A NEW APPLICATION AND TRAFFIC STUDY.

COMMISSIONER SCOTT ASKED A QUESTION REGARDING THE LETTER THE COMMISSION RECEIVED FOR THE WATER AND WASTEWATER MANAGEMENT FOR WINERIES COURSE AT U.C. DAVIS SCHEDULED FOR AUGUST 13, 2002.

MR. LEDERER RESPONDED THAT TRENT CAVE, DIRECTOR, ENVIRONMENTAL MANAGEMENT, IS TEACHING THE WATER AND WASTEWATER MANAGEMENT COURSE, AND HE IS LOOKING INTO THE POSSIBILITY OF MR. CAVE TEACHING AN IN-HOUSE COURSE.
