Request: Approval to modify Use Permit
Exemption #SW-198889 to: (1) increase the production capacity from 6,500 to
20,000 gallons per year; (2) construct a 1,400 square foot winery addition for
a total winery floor area of 2,789 square feet; (3) increase the number of
custom producers from one to six who will utilize 30% (6,000 gallons per year)
of the proposed production capacity; (4) modify custom production activities to
include retail wine sales, one administrative office, distribution and
shipping, tours and tasting by appointment only; (5) allow a maximum of two of
the four employees for custom production activities; and, (6) add a marketing
plan to recognize one private marketing event and add two custom producer
marketing events for a total of 3 annual private promotional events with a maximum
of 150 person per event, located on a 18.84 acre parcel at the terminus of
North Fork Crystal Springs Road approximately 3,000 feet east of Silverado

Declaration Prepared.
Request: Approval of a Use Permit to
establish a new 15,000-gallon per year winery with: (1) a 4,223 square foot building for fermentation, storage and
lab, a 2,632 square foot building for administration and storage and 4,885
square feet of caves for barrel storage for a winery totaling 11,740 square
feet; (2) two full-time employees with five additional full-time employees during crush; (3) a maximum of 30 visitors
per week; (4) six parking spaces; (5) tours and tasting by appointment only for
two to four people, four times per month; (6) a marketing plan with four
activities per year with a maximum of ten people per event and one luncheon
related to the wine auction for a maximum of 30 people; (7) construction of a
standard sewage system and storage tanks for domestic water storage and fire
protection; and, (8) improvements to the drainage at the intersection of North
Fork Crystal Springs Road and Silverado Trail, located on a 30.37-acre parcel
on the east side of North Fork Crystal Springs Road, approximately 1,738 feet

on existing hillside terraces; (3) custom crushing activities (crushing,
fermenting, barrel aging and bottling) for a maximum of one custom producer
utilizing 50% (10,000 gallons per year) of the total approved winery capacity;
(4) one full-time employee; (5) a maximum of 50 visitors per week; (6) 12

# U-18182 to allow the previously approved winery to the following: (1) increase production capacity from 85,000
gallons per year to 100,000 gallons per year; (2) revise the previously
approved #95081-MOD marketing plan which permitted 6-12 promotional events per
year with an average of 9 to 6-12 per year (removing the average of 9). No other changes
to the winery are proposed. The parcel
is located
on a 21.03-acre parcel on the east side of Highway 29, approximately 1,250 feet

Report on Board of Supervisors' Actions.
BOB NELSON, SUPERVISING
PLANNER, ADVISED THE FIREWORKS POLICY HAS BEEN CHANGED. FIREWORKS ARE NOW HANDLED BY THE DEPARTMENT OF FORESTRY AND
ARE SEPARATE FROM TEMPORARY EVENTS LICENSES.
IN RESPONSE TO MR. NELSON’S
REPORT REGARDING FIREWORKS, THE COMMISSION RECOMMENDED THIS ITEM BE DISCUSSED
AT THE NEXT PLANNING COMMISSION MEETING WHEN COMMISSIONER HOLZHAUER IS PRESENT,
SINCE HE INITIATED THE FOLLOW-UP TO THIS ITEM.
MR. NELSON PROVIDED COMMENTS
IN RESPONSE TO PUBLIC TESTIMONY PROVIDED EARLIER TODAY ALONG WITH
COMMISSIONER’S CONCERNS AS THEY RELATE TO SECOND UNITS AND GUEST UNITS. HE ADVISED THESE UNITS ARE CONSTANTLY
CAUSING PROBLEMS WITHIN THE DEPARTMENT AND HE WOULD NOT MIND SEEING CLEAN-UP
LANGUAGE TO CLARIFY CURRENT DEFINITIONS TO THE ORDINANCE.

STAFF PREPARE DRAFT CLEAN-UP LANGUAGE TO CLARIFY THE DEFINITIONS OF SECOND
UNITS AND GUEST UNITS FOR DISCUSSION AT A FUTURE PLANNING COMMISSION MEETING.

DIRECTOR, REPORTED ON THE FOLLOWING:
THE BOARD OF SUPERVISORS AT
THEIR MEETING JULY 9, 2002 DECLARED INTENT TO DENY THE APPEAL OF THE GROVER WINERY USE PERMIT NO. 00325-UP AND UPHELD THE DECISION BY THE PLANNING COMMISSION. IN ADDITION, THE BOARD REQUESTED THE
PLANNING DEPARTMENT AND COUNTY FIRE CONTINUE
TO LOOK AT WHAT PERMITS THE COUNTY APPROVES IN THE HILLSIDES AS THEY
RELATE TO FIRE ISSUES.
THE BOARD OF SUPERVISORS
WILL CONSIDER AN EXTENSION OF THE STREAM SETBACK URGENCY ORDINANCE AT THEIR
MEETING JULY 23, 2002. THE ORDINANCE
WILL LIKELY BE EXTENDED UNTIL AN INTERMEDIATE ORDINANCE IS APPROVED.
THE BOARD OF SUPERVISORS AT
THEIR MEETING JULY 16, 2002 CONSIDERED A REVISED, SMALLER PROJECT SUBMITTED BY
THE APPLICANT FOR CARNEROS LODGE AND AUTHORIZED STAFF TO MOVE FORWARD WITH
PREPARATION OF A REVISED FINAL ENVIRONMENTAL IMPACT REPORT. STAFF HAD PREPARED A WATER ANALYSIS BASED
ON A 70 PERCENT OCCUPANCY, AND THE BOARD SUGGESTED THE WATER ANALYSIS BE
PREPARED BASED ON 80 PERCENT OCCUPANCY IN ORDER TO PROVIDE A MARGIN OF ERROR. THE
BOARD WILL CONSIDER THIS PROJECT AT ITS HEARING SET FOR AUGUST 20, 2002.

QUESTION REGARDING THE LETTER THE COMMISSION RECEIVED FOR THE WATER AND
WASTEWATER MANAGEMENT FOR WINERIES COURSE AT U.C. DAVIS SCHEDULED FOR AUGUST

ENVIRONMENTAL MANAGEMENT, IS TEACHING THE WATER AND WASTEWATER MANAGEMENT
COURSE, AND HE IS LOOKING INTO THE POSSIBILITY OF MR. CAVE TEACHING AN IN-HOUSE
COURSE.
