COUNSEL. MR. PAUL IS AN EXPERIENCED
LAND USE ATTORNEY AND WILL BE WORKING ON THE PROPOSED ZONING ORDINANCE
AMENDMENT FOR THE VIEWSHED PROTECTION PROGRAM.

Proposed Zoning Ordinance Amendment
#00214-ORD amending Title 18
of the Napa County Code to add a new Chapter 18.106, entitled Viewshed Protection Program, regulating
the placement and design of certain structures in the unincorporated portions
of Napa County. Structures proposed to
be located on slopes of 15% or greater or on ridgelines as defined by the
proposed ordinance would be affected by the ordinance and required to satisfy
criteria included in the ordinance prior to issuance of building permits. The proposed ordinance establishes design
criteria, exemptions, exception procedures, findings, and penalties for
unauthorized vegetation removal.
CEQA Status: Negative Declaration
Prepared. According to the Negative
Declaration, the proposed project would have, if mitigation measures are not
included, potential environmental impacts in the following areas: none.

Act (CEQA) Status: Draft EIR Prepared.
REQUEST FOR: REVIEW AND PUBLIC
TESTIMONY ON DRAFT ENVIRONMENTAL IMPACT REPORT PREPARED FOR THE BERINGER WINE
ESTATES DEVLIN ROAD FACILITY LOCATED WITHIN THE NAPA COUNTY AIRPORT INDUSTRIAL
AREA SPECIFIC PLAN. THE HEARING OF JUNE
27 CONSIDERS COMMENTS ON THE DRAFT EIR ONLY.
A SUBSEQUENT HEARING WILL BE HELD FOR THE PURPOSES OF CERTIFICATION OF A
FINAL EIR AND AN ACTION ON THE APPLICANT’S USE PERMIT APPLICATION.
The project is a request to establish a 1,424,400-square foot facility
consisting of 1,167,590 square feet of wine warehouse and storage area; 60,000
square feet of ancillary offices, administrative, and laboratory area; and
196,810 square feet of related uses (wine crushing, blending, bottling, and
employee areas, etc.). The project also
proposes approximately 115 acres of vineyards; preservation of a riparian and
wildlife corridor along “No Name” Creek; a wetlands mitigation program; winery
process wastewater ponds; storage ponds for irrigation of vineyards with
reclaimed and treated wastewater; and extensive site landscaping. The site encompasses 218 acres, APN
57-090-069.
Location: The project site is 218 acres, located
at the southwest intersection of South Kelly Road and Devlin Road, adjacent to
the Napa County Airport on the south side within an IP:AC (Industrial Park:
Airport Compatibility Combination) zoning district. The site is bounded on the east by the Union Pacific Railroad
right-of-way.
