Chief Probation Officer requests adoption of a resolution approving the Comprehensive Multi-Agency Juvenile Justice Plan Application for Challenge Activities for Fiscal Year 2004-2005 with the State Board of Corrections and authorizing the Chief Probation Officer to sign and submit the application in the amount of $10,000 augmenting current juvenile justice programs.

District Attorney requests the following actions in connection with the State of California Department of Justice Domestic Violence Spousal Abuser Program for Fiscal Year 2004-2005:

  1. Authorization to sign a grant award in the amount of $33,913; and
  2. Adoption of a resolution approving $6,652 in County General Fund monies as match.

District Attorney requests approval of and authorization to sign a grant award, for Fiscal Year 2004-2005, with the Governor's Office of Emergency Services in the amount of $101,972, with no County match required, to continue funding for vertical prosecution of Statutory Rape and Elder and Dependant Adult Abuse cases.

District Attorney requests approval of and authorization for the Chair to sign an agreement with DiMichelle Deposition Reporters of Northern California for a maximum of $50,000 for the term July 1, 2003 through June 30, 2004, with automatic yearly renewal, for transcription and translation of audio and video tapes.

Director of Health and Human Services requests approval of and authorization for the Chair to sign Amendment No. 1 to Agreement No. 2390 with the California Department of Mental Health for the Conditional Release Program (CONREP), increasing the amount by $12,000 for a new maximum of $221,975 to compensate the County for medication costs.

Director of Health and Human Services requests approval of and authorization for the Chair to sign Amendment No. 1 to Agreement No. 4464 with Telecare Corporation increasing the amount by $40,000 for a new maximum of $50,000 to provide mental health services to uninsured clients.


6G

Director of Health and Human Services requests approval of and authorization for the Chair to sign the following amendments to provide services in the Mental Health Outpatient Managed Care Program:

  1. Amendment No. 1 to Agreement No. 4546 with Susan Schmall, Ph.D., increasing the amount by $2,000 for a new maximum of $7,000; and
  2. Amendment No. 1 to Agreement No. 6085 with Cathy Parker, LCSW, increasing the amount by $2,000 for a new maximum of $4,500.

Director of Health and Human Services requests approval of Budget Transfer No. 81 increasing appropriations in the Behavioral Health budget by $40,000 with offsetting revenues from the SAMHSA Supportive Living grant to fund current year expenditures. (4/5 vote required)

Director of Public Works requests adoption of a resolution temporarily closing a portion of Buchli Station Road, Las Amigas Road, and Duhig Road from 7:00 A.M. to 9:00 A.M. on Sunday, July 11, 2004 for the Napa to Sonoma Wine Country Half Marathon.

Director of Public Works requests the second reading and adoption of an ordinance adding Chapter 16.28 - Stormwater Management and Discharge Control Ordinance.

Clerk of the Board requests approval of and authorization for the Registrar of Voters to consolidate and conduct a City of Calistoga Municipal Election as requested by the City of Calistoga (Resolution No. 2004-048) with the Election to be held November 2, 2004, with the provision that all services rendered by the County for the City in connection with such election be reimbursed in full.

County Counsel requests approval of and authorization for the Chair to sign an agreement with Michael H. Keeley for a maximum of $61,800 for the term July 1, 2004 through June 30, 2005 to provide conflict public defender services, with provisions for automatic annual renewal and reimbursement for costs and services for extraordinary cases in addition to the maximum amount.

Registrar of Voters requests discussion and possible action by the Board of Supervisors as follows: 

  1. Receive Certification of sufficiency of signatures for the Rural Dining Initiative.  
  2. Pursuant to Elections Code 9111 and 9118, take one of the following actions:
    1. Order a report on the Rural Dining Initiative, discussing:
      1. its fiscal impact,
      2. its effect on the: (1) internal consistency of the County’s general and specific plans, including the housing element; (2) consistency between planning and zoning regulations of the County; and  (3) limitations imposed on the County by Government Code section 65008 (discrimination in housing), section 65913 (affordable housing) or section 65915 (low income housing and density bonuses); (4) the effect on the use of land, the impact on the availability and location of housing, and the ability of the county to meet its regional  housing needs; (5) the impact on funding for infrastructure of all types, including, but no limited to, transportation, schools, parks, and open space; (6) the impact on the community’s ability to attract and retain business and employment; (7) the impact on the uses of vacant parcels of land; and (8) the impact on agricultural lands, open space, traffic congestions, existing business districts, and developed areas designated for revitalization, and/or
      3. any other matters the Board might wish to have included in the report; OR
    2. Adopt a resolution calling an election and consolidating it with the next statewide election for the purpose of enabling the people of Napa County to approve or reject the Rural Dining Initiative; OR
    3. Adopt the Rural Dining Initiative as an ordinance without any change and without a vote of the people within 10 days after certification of the petition is presented to the Board.

County Executive Officer requests approval of and authorization for the Chair to sign the renewal of Agreement No. 3295 with the State of California for a maximum of $55,600 for the term July 1, 2004 through June 30, 2005, with offsetting revenue from the State of California, for the Arts in Mental Health Program.

County Executive Officer requests acceptance of resignation of Bruce Heid from the position of Director of Health and Human Services, effective August 1, 2004.


6P

County Executive Officer/Purchasing Agent requests the following (4/5 vote required):

  1. Declare certain items of personal property as surplus and no longer required for public use; and
  2. Authorize the Purchasing Agent to dispose of these items of personal property by donating them Napa Valley Personal Computers, a tax-exempt Health and Human Service organization.

Director of Health and Human Services requests the following actions pursuant to Section 1442.5 of the California Health & Safety Code, also known as the "Beilenson Act", and other applicable laws:

  1. Hold a public hearing for the community to comment on the proposed reductions in public health services; and
  2. Upon consideration of public comments of the proposed reductions, take action to approve the reductions, effective July 1, 2004.
