1.                  Call to Order.

THE CONSERVATION, DEVELOPMENT AND PLANNING COMMISSION OF THE COUNTY OF NAPA MET IN REGULAR SESSION, WEDNESDAY, FEBRUARY 18, 2004, AT 9:00 A.M.  THE MEETING WAS CALLED TO ORDER BY CHAIR SCOTT AT 9:03 A.M.

 

 

2.                  Roll Call.

THE FOLLOWING MEMBERS WERE PRESENT:  CHAIRPERSON TERRY SCOTT, COMMISSIONERS BOB FIDDAMAN, JIM KING, DAVID GRAVES AND JOHN DICKSON.

BOB NELSON, SUPERVISING PLANNER, ADVISED THAT ITEM 13 - DIAMOND MOUNTAIN VINEYARDS - USE PERMIT MODIFICATION REQUEST #03452-MOD WILL BE REMOVED FROM THE AGENDA.

STEVE LEDERER, DEPUTY PLANNING DIRECTOR, COMMENTED ON ITEM 13 AND ADVISED THERE WERE FOUR AREAS OF CONCERN WITH THIS ITEM:  1) SONOMA COUNTY PROVIDED EVIDENCE FROM THEIR FILES THAT THE HELIPORT IS LOCATED IN SONOMA COUNTY AND DETERMINED IT IS NOT THE JURISDICTION OF NAPA COUNTY, 2) SONOMA COUNTY REQUESTED NOISE SURVEY INFORMATION, 3) FISH & GAME INDICATED THE AREA MIGHT BE A HABITAT FOR THE SPOTTED OWL AND REQUESTED INFORMATION, 4) CALTRANS AERONAUTICS AND THE FEDERAL AVIATION ADMINISTRATION ORIGINALLY DID NOT WANT JURISDICTION OVER THE PROJECT AND THE PLANNING DEPARTMENT RECEIVED A LETTER YESTERDAY STATING THAT THEY NOW WANT JURISDICTION.

8.                  Proposed Ordinance #04001-ORD updating and making technical changes to Section 18.10.020; Sections 18.40.020, 18.40.060, 18.40.110, 18.40.170, 18.40.240, and 18.40.250; Sections 18.44.080, 18.44.090, 18.44.120, 18.44.170 and adding Section 18.44.210; Chapter 18.80.; Section 18.104.010; Section 18.110.030; and Section 18.116.045 of the Napa County Code relating to: a) updating for consistency with the Napa County Airport Land Use Compatibility Plan; b) establishment of a process for modification to site development standards; c) miscellaneous technical corrections; and, d) updating signage regulations.      
California Environmental Quality Act (CEQA) Status:  Categorically Exempt, Class 5 (CEQA Guidelines Section 15303), Minor alterations to land use limitations.

9.                  Proposed Specific Plan Amendment #SPAMD 0101 updating and making technical changes to the 1986 Airport Industrial Area Specific Plan relating to: a) updating for consistency with the Napa County Airport Land Use Compatibility Plan; b) establishment of a process for modification to site development standards; c) miscellaneous technical corrections; and, d) updating signage regulations.  The Airport Specific Plan regulations pertain to lands within the County of Napa generally located south the intersection of State Routes 29 and 221, west of Kelly Road, east of the Napa River, and north of Green Island Road within the IP:AC (Industrial Park: Airport Compatibility Combination District), the GI:AC (General Industrial: Airport Compatibility Combination District), AV:AC (Airport: Airport Compatibility Combination District), and the I:AC (Industrial: Airport Compatibility Combination District).

10.              Lakeview Boat Storage, LLC / Lakeview Boat Storage - Rezoning Request #03351-RZG        
CEQA Status:  See Item #11.  
Request:  Approval to rezone a 4.70 acre portion of a 30.7 acre parcel from AW (Agricultural Watershed) to MC (Marine Commercial) zoning district, for a boat storage operation located on
two parcels, a 30.74± parcel (Assessor’s Parcel #: 019-280-006) and a 2.10± parcel (Assessor’s Parcel #: 019-280-004) on the east side of Knoxville-Berryessa Road, approximately one-half mile south of its intersection with Pope Canyon Road; within a MC (Marine Commercial) zoning district and an AW / MC (Agricultural Watershed / Marine Commercial) split zoning district.  (Assessor’s Parcel #s: 019-280-004 and 019-280-006) 7150 and 7140 Berryessa Knoxville Road, Napa.

11.              Lakeview Boat Storage, LLC / Lakeview Boat Storage – Use Permit Request #03352-UP       
CEQA Status: 
Mitigated Negative Declaration Prepared.  According to the Mitigated Negative Declaration, the proposed project would have, if mitigation measures are not included, potentially significant environmental impacts in the following areas:  aesthetics, hazards and hazardous materials, hydrology and water quality, noise and transportation/traffic.    
Request:  Approval of a Use Permit to expand the existing boat storage area with:  (1) eight new storage buildings with 71 new enclosed units for a new total of 283 enclosed units and 52 covered units; (2) a new impervious driveway and parking areas totaling 23,750 square feet, for a new total impervious improved area of 68,750 square feet or approximately 1.5 acres; (3) new non-impervious areas for trailer storage totaling 54,650 square feet; and, (4) improvements to Berryessa-Knoxville Road including a left turn lane for southbound traffic and a right turn lane for northbound traffic, located on two parcels, a 30.74

13.              Diamond Mountain Vineyards - Use Permit Modification Request #03452-MOD          
CEQA Status:  Mitigated Negative Declaration Prepared.  According to the Mitigated Negative Declaration, the proposed project would have, if mitigation measures are not included, a potentially significant environmental impact in the following area:  noise.         
Request:  Approval to modify Use Permit #s 93427-UP, 96493-MOD and 02024-MOD to allow for previously approved tours and tasting guests (by appointment only) to arrive and depart by helicopter during the hours of 10:00 a.m. to sunset. No additional construction, changes in existing visitation numbers or production levels are requested by the Modification.  No other changes to the winery are proposed.  The project is located on a 54.37 acre parcel at the terminus of Diamond Mountain Road, at the Napa/Sonoma County border, approximately three miles from its intersection with Saint Helena Highway North (St. Highway 29) within the AW (Agricultural Watershed) zoning district.  (Assessor’s Parcel # 020-100-012)  2121 Diamond Mountain Road, Calistoga.  (This application is no longer being processed because it has been determined that Napa County does not have jurisdiction over the proposed location)

15.              Commissioner Comments.

COMMISSIONER GRAVES COMMENTED ON A LETTER THE COMMISSION RECEIVED FROM LOIS BATTUELLO REGARDING THE ZONING ADMINISTRATOR AND THE PLANNING COMMISSION.

 

COMMISSIONER DICKSON COMMENTED THAT HE WILL BE ATTENDING A COURSE AT THE U.C. DAVIS EXTENSION FOR THE ROLE OF A PLANNING COMMISSIONER ON FEBRUARY 27, 2004.

 

CHAIR SCOTT COMMENTED ON THE BOARD OF DIRECTOR’S MEETING FOR THE CALIFORNIA COUNTY PLANNING COMMISSIONERS ASSOCIATION ON FEBRUARY 7, 2004 THAT HE AND COMMISSIONER KING ATTENDED.  HE STATED THAT JIM KING, FORMER PRESIDENT OF THE ASSOCIATION, PROVIDED A REPORT ON THE ANNUAL CONFERENCE HELD IN NAPA LAST NOVEMBER.  THE CONFERENCE WAS VERY SUCCESSFUL IN TERMS OF ATTENDANCE AND FEEDBACK FROM COMMISSIONERS REGARDING THE EXCELLENT SUPPORT FROM COUNTY PLANNING STAFF AND THE QUALITY OF THE PROGRAM, WHICH IS A COMPLIMENT TO COMMISSIONER KING AND PLANNING STAFF.

 

COMMISSIONER KING REITERATED CHAIRMAN SCOTT’S COMMENTS ABOUT PLANNING STAFF AND INDICATED THE CONFERENCE COULD NOT HAVE BEEN DONE WITHOUT THEM.

 

 

16.              Director's Report on Board of Supervisors' Actions.

MR. LEDERER REPORTED THE BOARD CONSIDERED THE MONTALCINO APPEAL ON FEBRUARY 10, 2004 AND TENTATIVELY AGREED TO SUSTAIN THE APPEAL OF THE APPLICANT, WHICH IS EFFECTIVELY REVERSING THE DENIAL OF THE USE PERMIT.  THE HEARING CONCLUDED WITH THE BOARD DIRECTING STAFF TO PREPARE ADDITIONAL CONDITIONS OF APPROVAL AND TO MAKE SOME CHANGES TO THE ORIGINALLY PROPOSED CONDITIONS OF APPROVAL.  THE PROJECT IS SCHEDULED TO RETURN TO THE BOARD ON MARCH 9, 2004 TO REVIEW THE CONDITIONS OF APPROVAL, AND ON MARCH 16, 2004 THE BOARD WILL CONSIDER ADOPTION OF THE FINDINGS OF FACT.

COMMISSIONER FIDDAMAN INQUIRED AS TO THE TIMING TO START THE GENERAL PLAN UPDATE.

 

MR. LEDERER RESPONDED THE BOARD HAS PROVIDED GENERAL DIRECTION TO STAFF, BUT A SPECIFIC DATE HAS NOT BEEN SCHEDULED.
