1.                   Call to Order.

THE CONSERVATION, DEVELOPMENT AND PLANNING COMMISSION OF THE COUNTY OF NAPA MET IN SPECIAL SESSION, WEDNESDAY, SEPTEMBER 25, 2002, AT 9:00 A.M.

 

2.                   Roll Call.

THE FOLLOWING MEMBERS WERE PRESENT: CHAIRMAN DAVID GRAVES, COMISSIONERS TONY HOLZHAUER, TERRY SCOTT AND JIM KING. COMMISSIONER LARRY SCHOENKE WAS EXCUSED AT ROLL CALL, BUT ARRIVED FOR ITEM 6.

IRVING THOMAS EXPRESSED HIS CONCERNS REGARDING COMMISSIONER SCOTT’S COMMENT AT A PRIOR MEETING ABOUT AN “ENVIRONMENTAL FILLIBUSTER”.

5.                  Schutz Winery / Jurgen and Marie Schutz – Use Permit Request #01275-UP

California Environmental Quality Act (CEQA) Status:  Categorically Exempt
Request:  Approval of a Use Permit to establish a new 20,000-gallon per year winery within an existing 12,800 square feet industrial building currently used for wine storage for a winery totaling 12,800 square feet, and:  1) continuation of the existing approved wine storage/aging operation; 2)
construction of an interior 15 foot by 15 foot crushing and press operation with wastewater holding tanks; 3) custom crushing activities (crushing, fermentation, barrel aging and bottling) for up to 12 custom producers that currently store bulk wine at the facility (as previously approved) utilizing up to 50% (10,000 gallons per year) of the total approved winery production capacity; 4) two full-time and one part-time employees; 5) forty-four parking spaces (existing); 6) no general public tours and tasting; 7)  a marketing plan with unlimited private tastings with no more than ten wine industry representatives and one special event with a maximum of 100 wine industry representative per year; 8) operation of a mobile bottling line; and,  9) connection to City of American Canyon water service and Napa Sanitation District sewer facilities.  The parcel is located on a 1.07 acre parcel at the southern end of Camino Oruga adjoining North Kelly Road approximately 450 feet north of Executive Way within the IP:AC (Industrial Park: Airport Compatibility) zoning district.  (Assessor’s Parcel # 057-190-020)  210 Camino Oruga, Napa   (Continued from September 18, 2002)

THE COMMISSION FINDS THAT THE PROJECT IS EXEMPT FROM THE PROVISIONS OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT UNDER SECTION 15301, CLASS 1, EXISTING FACILITIES, CONSISTING OF THE MINOR ALTERATION OF AN EXISTING FACILITY INVOLVING NEGLIGIBLE EXPANSION.

6.                  Proposed Zoning Ordinance Amendment Request (#02304-ORD) to amend Chapter 18.108 (Conservation Regulations) by amending Sections 18.108.020 (General Provisions), 18.108.025 (General Provisions-Intermittent/Perennial Streams), 18.108.030 (Definitions), 18.108.040 (Exceptions), 18.108.050 (Exemptions), and 18.108.055 (Exemption from Discretionary Permit) and to amend Chapter 16.04 (Floodplain Management) by repealing Section 16.04.750 (Riparian Zones-Restricted Activities) of the Napa County Code.  The proposed ordinance will:

Establish for County regulatory purposes a new biologically-based stream classification system similar to that used by the State Department of Forestry and the State Department of Fish & Game;

a)                 Increase stream setbacks to 150 feet on all Class I & II streams as defined under the ordinance and 25 feet on all Class III streams;

b)                 Limit the activities that are allowed within a portion of the stream setbacks;

c)                 Establish procedures and criteria for approving reduced stream setbacks;

d)                 Provide new definitions and clarify existing definitions; and,

e)                 Repeal certain out-dated provisions of the Floodplain Management Ordinance that may conflict with the new regulations being established hereunder.

CEQA Status:  Categorically Exempt, Class 8 (CEQA Guidelines Section 15308).

COMMISSIONER HOLZHAUER WILL ACT AS TEMPORARY CHAIRMAN UNTIL VICE-CHAIRMAN SCHOENKE ARRIVES AT 1:30 P.M. TODAY.
