THE CONSERVATION, DEVELOPMENT AND PLANNING COMMISSION OF THE COUNTY OF NAPA MET IN REGULAR SESSION, WEDNESDAY, AUGUST 1, 2001 AT 9:00 A.M.

-         THE DEPARTMENT WILL BEGIN RECRUITMENT FOR THREE NEW POSITIONS APPROVED BY THE BOARD OF SUPERVISORS.

-         PROPOSALS FOR THE CONSERVATION, DEVELOPMENT & PLANNING COMMISSION ARE CURRENTLY BEING PREPARED BY CONTRACT CONSULTANTS AND THE DEPARTMENT WILL CONTINUE THAT PRACTICE UNTIL VACANCIES ARE FILLED. 

 

7.                  Agenda Review.

Public Hearings

8.                   Proposed Zoning Ordinance Amendment #00214-ORD amending Title 18 of the Napa County Code to add a new Chapter 18.106, entitled Viewshed Protection Program, regulating the placement and design of certain structures in the unincorporated portions of Napa County.  Structures proposed to be located on slopes of 15% or greater or on ridgelines as defined by the proposed ordinance would be affected by the ordinance and required to satisfy criteria included in the ordinance prior to issuance of building permits.  The proposed ordinance establishes design criteria, exemptions, exception procedures, findings, and penalties for unauthorized vegetation removal.

California Environmental Quality Act (CEQA) Status:  Negative Declaration Prepared.  According to the Negative Declaration, the proposed project would have, if mitigation measures are not included, potential environmental impacts in the following areas:  none.

9.                   Draft Update Of Napa County General Plan Housing Element- Proposed General Plan Amendment #GPA 01-02           
CEQA Status:  Initial Study pending.           
REQUEST:  To initiate public review and receive comments on the draft Napa County Housing Element Update and scope of any necessary CEQA actions, and take possible action to forward the draft Housing Element as modified by the Commission to the State Department of Housing and Community Development (HCD) for their comments within the statutory 60-day review period.           
FUTURE ACTIONS: Following receipt of comments by HCD, the Commission will conduct additional public hearings to receive comments on the Draft Housing Element Update including possible revisions in response to comments submitted by HCD and to consider and take required actions pursuant to CEQA anticipated in October, 2001.  After the public hearing, the Planning Commission will make a recommendation to the Board of Supervisors regarding action on the proposed environmental determination and General Plan Housing Element Update.  The Board will schedule separate public hearings.

10.               Carneros Partners, Inc. – Use Permit Request #98511-UP

CEQA Status:  Environmental Impact Report Prepared.     
REQUEST:  Approval to establish a 100-unit resort, including the construction of lodge structures and guest cottages, a 100-seat restaurant with indoor and outdoor seating, banquet and meeting rooms, a maximum 10,000 square foot retail facility including food and post office, administrative offices, recreational improvements, water treatment and sewage treatment facilities, a 10,000 square foot public square and parking for 191 vehicles, located on three parcels totaling 10.48 acres adjacent to and northeast of the intersection of State Highway 12/121 (Carneros Highway) and Old Sonoma Highway within a CL (Commercial Limited) zoning district (Assessor’s Parcels #47-110-025 and 47-110-026), and "access parcel" (Assessor’s Parcel #47-110-019) within an AW (Agricultural Watershed) zoning district. The proposed project is adjacent to, and integrated with, the Carneros Inn Recreational Vehicle Park/Mobile Home Park Facility under construction (pursuant to Use Permit #98290-MOD), and is more fully described and evaluated in the Draft Environmental Impact Report for Carneros Lodge, the written public comment period for which was advertised and held between April 19 and June 4, 2001.

PUBLIC HEARING HELD – TESTIMONY PRESENTED

 

THE COMMISSION HAS READ AND CONSIDERED THE FINAL ENVIRONMENTAL IMPACT REPORT FOR CARNEROS LODGE (CONSISTING OF TWO VOLUMES) PRIOR TO TAKING ACTION ON SAID ENVIRONMENTAL IMPACT REPORT (EIR) AND THE PROPOSED PROJECT, FINDS THAT THE EIR IS BASED ON THE INDEPENDENT JUDGMENT OF THE PLANNING COMMISSION, FINDS THAT THE EIR IS PREPARED IN CONFORMITY WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT AND CERTIFIES THE ENVIRONMENTAL IMPACT REPORT.

11.               Todd Humphries – Final Map Amendment Request #00518-MAPA

CEQA Status:  Categorically Exempt     
REQUEST:  Approval to eliminate a slope easement and a sewage disposal easement for Lot 3 of the Deer Park Estates Unit #1 Final Map located on the northwest corner of Camino Vista and Via Monte within an AW (Agricultural Watershed) zoning district.  (Assessor's Parcel #25-341-003)  255 Via Monte.

ENVIRONMENTAL DETERMINATION:  NONE REQUIRED.  CATEGORICALLY EXEMPT (CLASS 5).

THE COMMISSION APPROVED FINAL MAP AMENDMENT #00518-MAPA WITH FINDINGS TO ELIMINATE THE SLOPE EASEMENT AND THE SANITARY DISPOSAL EASEMENT FOR LOT 3 OF THE DEER PARK ESTATES UNIT #1 FINAL MAP AND RECORD THE CERTIFICATE OF CORRECTION.

12.               Paraduxx (Duckhorn) – Variance Request #00165-VAR     
CEQA Status:  See item below     
REQUEST:  Approval of a variance from the 600-foot winery road setback regulations (Section 18.104.230(A)(1)) to permit the modification and utilization of 7,878 square feet of existing structures located 402 feet from the centerline of Silverado Trail for winery tasting, hospitality, offices and storage located a 45.56 acre parcel on the west side of Silverado Trail, north of Yountville Cross Road and south of Rector Creek within an AP (Agricultural Preserve) zoning district.  (Assessor’s Parcel #31-170-019)   7257 Silverado Trail.

13.               Paraduxx (Duckhorn) – Use Permit Request #00164-UP     
CEQA Status: Negative Declaration Prepared.  According to the Negative Declaration, the proposed project would have, if mitigation measures are not included potentially significant environmental impacts in the following areas: aesthetics/light & glare, biological resources, cultural resources, hydrology & water quality and noise.     
REQUEST: Approval to establish a 156,000-gallon per year winery facility utilizing existing and proposed structures with a total developed and modified floor area of 38,592-square feet, including scheduled tours and marketing events for invited guests only, 5 full-time and 2 part-time employees and a new well, located on a 45.56 acre parcel on the west side of Silverado Trail north of Yountville Cross Road and south of Rector Creek within an AP (Agricultural Preserve) zoning district, (Assessor’s Parcel #31-170-019)  7257 Silverado Trail.

CHAIRMAN KING ON BEHALF OF THE COMMISSION INVITED MIKE MILLER, DEPUTY PLANNING DIRECTOR, TO THE AUGUST 15, 2001 PLANNING COMMISSION MEETING TO RECEIVE HIS RETIREMENT RESOLUTION.

 

18.               Director's Report on Board of Supervisors' Actions.

CHARLES WILSON, DIRECTOR, CONSERVATION DEVELOPMENT & PLANNING DEPARTMENT REPORTED THAT AT A BOARD OF SUPERVISORS’ MEETING HELD JULY 31, 2001, TESTIMONY WAS PRESENTED REGARDING THE MONTALCINO PROJECT.  THERE WAS CONSIDERABLE DISCUSSION IN REGARD TO THE NAPA COUNTY GENERAL PLAN AND CONSISTENCIES IN THE AREAS OF AGRICULTURE AND RECREATIONAL COMPATIBILITY.  THE BOARD OF SUPERVISORS CONTINUED THIS ITEM TO SEPTEMBER 11, 2001.

 

19.               Zoning Administrator Actions for July 2001.

MIKE MILLER, DEPUTY ZONING ADMINISTRATOR, ADVISED THAT HE COMPLETED THE REVIEW OF FRANK FAMILY VINEYARD (KORNELL) WINERY USE PERMIT MODIFICATION #00462 AND WILL PROVIDE THE COMMISSION WITH THE MODIFIED CONDITIONS OF APPROVAL.
