MOSSER RESIDENCE – NEVEO AND MARLO MOSSER, CONSERVATION REGULATION USE PERMIT EXCEPTION #P13-00389-UP

CEQA Status: Negative Declaration Prepared. According to the  Negative Declaration, the proposed project would not have a potentially significant environmental impact. The project site is not on any of the lists of hazardous waste sites enumerated under Government Code Section 65962.5.

Request:
Approval of an “Exception” to the Conservation Regulations in the form of a Use Permit (P13-00389), Napa County Code 18.108.040(A) to allow the construction of a pool and pool house on a slope over 30%. The following components have been specifically included under this request: 1) grading work on slopes exceeding 30%; 2) construction of a pool house approximately 1,130 square feet in size; and 3) construction of a pool 42 feet in length and 18 feet in width. The project is located on a 65.46-acre parcel and accessed via a private driveway located off Monticello Road; 90 Longhorn Ridge Road; Napa, CA 94558; APN: 032-170-038.

Staff Recommendation: Adopt the Negative Declaration and approve the project with attached conditions of approval.

RELEASE OF NAPA COUNTY DRAFT 2014 HOUSING ELEMENT UPDATE
REQUEST:  Presentation and discussion on the initial Draft Housing Element Update for the Planning Period of January 31, 2015 to January 31, 2023. State law requires every city and county to update the Housing Element of its General Plan periodically. The most recent update of Napa County’s Housing Element was adopted in 2009 and covered a period of time that will end this year. The interval between updates has been increased from five (5) years to eight (8) years, beginning with the current update.  After the presentation, the Commission will receive public comment and provide comments on the Draft.  Staff will make any necessary revisions as a result of comments and the direction given by the Planning Commission, and the Draft Housing Element will then be submitted to the State Department of Housing and Community Development (HCD) for its review. The statutory requirements for state review are contained in Government Code Section 65585.  Following receipt of HCD comments, anticipated in the Spring or Summer of 2014, staff will make any necessary revisions to the Draft and return the matter to the Planning Commission for a noticed public hearing. The Planning Commission will forward a recommendation to the Board of Supervisors, who will conduct a noticed public hearing before acting on the proposal.

RECOMMENDATION: Receive presentation and public comments, and provide comments to staff.

MOBILEHOME PARK ORDINANCE UPDATE / MATT MUMFORD, HALL VINELAND LLC - ORDINANCE TEXT AMENDMENT P13-00437-ORD
CEQA Status:
  General Rule.  It can be seen with certainty that there is no possibility the proposed action may have a significant effect on the environment and therefore CEQA is not applicable. [See Guidelines For the Implementation of the California Environmental Quality Act, 14 CCR 15061(b)(3)].

Request:
  Applicant-sponsored ordinance to update the Mobilehomes Chapter of Napa County Code, Chapter 15.40, to be consistent with the requirements of State Law and to establish regulations enabling project decision makers to grant variations to development standards for projects of superior design quality.  Applicant for the ordinance change is Hall Vineland LLC, 401 St. Helena Highway South, St. Helena.  Hall Vineland LLC has also proposed Major Modification P13-00164-MOD to redevelop the existing Vineland Vista Mobile Home Park located at 341 St. Helena Highway South (Assessor's Parcel Number 027-130-005 & 006), which is presently a pending, but incomplete, application with no planned date for hearing.
